This week’s Current Court Report includes arraignments and dispositions from Monday’s Nantucket District Court session.
Michael K. Holdgate, 55, of Nantucket was arraigned on Oct. 30 charges of operating a motor vehicle under the influence of alcohol and negligent operation of a motor vehicle. He had not-guilty pleas entered on his behalf and was ordered to return to court Nov. 20 for a pretrial hearing.
Holdgate’s truck was involved in the Main Street Fountain hit and run Sunday night just after 10:30 p.m. While Holdgate has not been charged with the vandalism as of this writing, he is facing charges after allegedly coming “within feet” of hitting Nantucket Police Officers later in the night while operating his van and pulling into his driveway roughly two hours after his truck destroyed the fountain.
The investigation of the fountain vandalism brought officers to Holdgate’s home and upon arrival, they found his truck parked at his residence with heavy damage sustained to its front. The truck fit the exact description from witnesses on the scene of the vehicle involved in the hit and run.
As officers knocked on his door and waited for Holdgate to answer, he allegedly pulled quickly into his driveway while operating the van and came just feet away from striking two police officers. You can read the full story here.
Daniel A. Alper, 26, of Chestnut Hill had April 29 charges of negligent operation of a motor vehicle, leaving the scene of property damage, and a marked lanes violation dismissed after the Cape & Islands District Attorney’s Office declined to move forward with the case due to lack of cooperation from the alleged victim.
Megan Browers, 43, of Nantucket will have an Oct. 7 charge of operating a motor vehicle under the influence of alcohol continued without a finding for one year on the condition she complete a driver alcohol education program, forfeit her license for 45 days, pay a $250 program fee, $250 head-injury fee, $50 victim-witness fee, and $50 OUI assessment fee.
A charge of negligent operation of a motor vehicle stemming from the same incident will be continued without a finding for six months on the condition Browers completes her probation without a violation. She was found not responsible for a marked lanes violation.
Manuel D. Garcia Garcia, 49, of Nantucket will have a May 29 charge of operating a motor vehicle under the influence of alcohol continued without a finding for one year on the condition he complete a driver alcohol education program and forfeit his license for 45 days. All fees and fines were remitted.
A charge of negligent operation of a motor vehicle stemming from the same incident will be continued without a finding for six months on the condition Garcia complete his probation without a violation. Garcia was found not responsible on charges of speeding, failure to stop/yield, and a marked lanes violation.
Charles Martin McGowan, 32, of Nantucket will have Sept. 21 charges of possessing a burglarious instrument and attempted larceny continued without a finding for six months on the condition he complete his probation without a violation. A Duquette alternative was also ordered – meaning that if McGowan violates his probation, he would be sentenced to one year in the Barnstable House of Corrections.
A charge of defacing property stemming from the same incident was dismissed. He was ordered to pay a $90 victim-witness fee.
Delores Ramirez Interiono, 30, of Nantucket was arraigned on two Sept. 7 charges of assault & battery. She had not-guilty pleas entered on her behalf and was ordered to return to court Nov. 20 for a pretrial hearing.
Victor Manuel Tavarez, 30, of Nantucket was ordered to serve six months of pretrial probation on Sept. 17 charges of assault with a dangerous weapon (two counts) and assault. He will have the charges dismissed at the end of the six-month period on the condition he complete the probation without a violation and complies with any ordered treatments.
Shawn M. Unis, 33, of Nantucket had a July 9 charge of assault and battery on a family/household member dismissed at the Cape & Islands District Attorney’s Office declined to move forward with the case due to lack of cooperation from the alleged victim.
