Current Court Report – October 8, 2024

This week’s Current Court Report includes arraignments and dispositions from the Monday and Tuesday Nantucket District Court session, which is in the midst of its October jury week session.

Samuel A. Alvarado-Aguilar, 52, of Nantucket was arraigned on Sept. 23 charges of assault & battery, assault with a dangerous weapon, possessing a class B drug, and possessing a class C drug. He had not-guilty pleas entered on his behalf and was ordered to return to court Oct. 28 for a pretrial hearing.

Melvin A. Arita, 46, of Nantucket was arraigned on an Oct. 2 charge of operating a motor vehicle under the influence of alcohol. He had a not-guilty plea entered on his behalf and was ordered to return to court Oct. 28 for a pretrial hearing.

Andrew Lee Ballard, 42, of Osterville pleaded guilty to three June 9 charges of assault & battery on a family/household member. He was ordered to one year in the Barnstable House of Corrections with serve six months to serve. The remaining balance of six months will be suspended for 18 months on the condition he stay out of trouble upon being released from jail, complete a partner program, and stay away and have no contact with the victim in the case.

According to the police report, Ballard punched and “beat” the alleged victim at least three times with a closed fist after getting into an argument with the individual – causing the alleged victim to develop a lump above their right eye bone, a swollen left eye with scratches above and below the eyelid, scratch on their chin, swollen lips, and a bloody, scratched up chest.

Upon police officers arrival to the residence where Ballard was staying, they observed Ballard to have bloody knuckles on his right hand. When Ballard was arrested in June, he also had two open cases from a May 9 incident out of Barnstable District Court, which resulted in his bail being revoked on those matters. He has been held ever since.

Rohan Alrick Black, 40, of Nantucket was arraigned on two Sept. 16 charges of photographing an unsuspecting nude person. He had not-guilty pleas entered on his behalf and was ordered to return to court Oct. 28 for a pretrial hearing.

According to the police report, Black recorded a woman in his bedroom while she was not wearing any clothes – using a camera mounted in the upper corner of his bedroom.

The alleged victim told police she knew there was a camera in the bedroom and told Black she didn’t want to be recorded. Black allegedly told the victim that the camera did not work. Both the alleged victim and Black were in the room during the recording, which was about five seconds long.

After being continued without a finding for one year, Roberto Curvelo Campos, 36, of Nantucket had July 23, 2023 charges of operating a motor vehicle under the influence of alcohol and leaving the scene of property damage dismissed.

Gertaliano Alves Dasilva, 54, of Nantucket was arraigned on Oct. 6 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, speeding, and possessing an open container of alcohol in a motor vehicle. He had not-guilty pleas entered on his behalf and was ordered to return to court Nov. 4 for a pretrial hearing.

After being continued without a finding for one year, Luiz Antonio Da Silva Junior, 49, of Nantucket had Aug. 14, 2023 charges of operating a motor vehicle under the influence of drugs and negligent operation of a motor vehicle dismissed.

After being continued without a finding for one year, Joshua B. Gray, 43, of Nantucket had Sept. 4, 2023 charges of leaving the scene of property damage and operating a motor vehicle under the influence of alcohol dismissed.

Jose Antonio Juarez Castaneda, 27, of Nantucket was arraigned on Sept. 22 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, driving a vehicle with a child under eight years old and under 58 inches without a car seat (two counts), child endangerment while operating a motor vehicle under the influence of alcohol (two counts), and a marked lanes violation. He had not-guilty pleas entered on his behalf and was ordered to return to court Dec. 9 for a pretrial hearing.

Douglas Robert Lebda, 54, of Nantucket was arraigned on June 16, 2024 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, and a motor vehicle lights violation. He had not-guilty pleas entered on his behalf and was ordered to return to court Jan. 6 for a pretrial hearing.

Pedro Juarez Tirzo, 43, of Nantucket was arraigned on a Sept. 28 charge of assault & battery. He had a not-guilty plea entered on his behalf and was ordered to return to court Dec. 9 for a pretrial hearing.

After being continued without a finding for one year, Richard E. Moore, 57, of Nantucket had two May 27, 2023 charges of assault & battery dismissed.

After being continued without a finding for one year, Mario A. Pleitez, 42, of Nantucket had a Dec. 9, 2022 charge of negligent operation of a motor vehicle dismissed.

Paola A. Mejia Sanchez, 39, of Nantucket was arraigned on a Sept. 24 charge of assault & battery. She had a not-guilty plea entered on her behalf and was ordered to return to court Oct. 28 for a pretrial hearing.

Alvaro E. Vasquez Felipe, 28, of Nantucket, was found guilty on Oct. 3, 2022 charges of negligent operation of a motor vehicle and leaving the scene of property damage. He was ordered to serve six months in the Barnstable House of Corrections but will have the sentence suspended for one year on the condition he complete his probation without a violation and pay a $250 head-injury fee.

He was found not guilty on a charge of operating a motor vehicle under the influence of alcohol stemming from the same incident and was found not responsible on charges of marked lanes violation, possessing an open container of alcohol in a motor vehicle, and speeding.
