This week's Current Court Report includes arraignments and dispositions from Monday's Nantucket District Court session.
Roberto Da Rocha Silva, 59, of Nantucket, will have a Nov. 4, 2022 charge of negligent operation of a motor vehicle continued without a finding for one year on the condition he complete one year of probation without violation. A charge of operating a motor vehicle under the influence of drugs stemming from the same incident was dismissed as part of the plea deal, and he was found not responsible on a failure to keep right for oncoming vehicle and unlicensed operation of a motor vehicle.
Luiz Antonio Da Silva Junior, 48, of Nantucket, was arraigned on Aug. 14 charges of operating a motor vehicle under the influence of drugs, negligent operation of a motor vehicle, leaving the scene of property damage, and a marked lanes violation. He had not-guilty pleas entered on his behalf and was ordered to return to court Aug. 28 for a pretrial hearing.
According to the police report, Da Silva was involved in a car accident involving several vehicles on Aug. 14 at 11 West Creek Road. When officers responded to the scene, they allegedly observed Da Silva unsteady on his feet while having to hold onto the van so he wouldn't fall down.
One of the vehicle operators told police that Da Silva, who was driving a white Ford van, hit the back of the victim's van while they were leaving Daves Street. The alleged victim then said Da Silva turned left onto Pleasant Street before continuing onto West Creek Road where he proceeded to allegedly hit a parked Jeep and a parked Ford Bronco after crossing over from the right side of the roadway to the left. The alleged victim said once Da Silva stopped after hitting the Bronco, he approached Da Silva and had him exit the vehicle and take the keys out of the ignition.
When Da Silva spoke to officers, he told them that he had bought CBD from the Green Lady Dispensary. Officers had him perform roadside assessments but Da Silva said his ability to perform them well may be impaired since he recently had surgery on his hip.
After being continued without a finding for one year, Yuri Barbosa Da Silva, 25, of of Nantucket, had a March 8, 2022 charge of negligent operation of a motor vehicle dismissed.
Adrian Umbali Danvers, 25, of Nantucket, will have a March 22 charge of forging/misusing an RMV document dismissed on the condition he complete one year of pretrial probation for one year
Somers Donaldson, 62, of Nantucket, will have a May 30 charge of assault & battery with a dangerous weapon continued without a finding for three months and will have the charge dismissed on the condition he complete three months of probation without violation and pay a $50 victim-witness fee.
According to the police report, the victim in the case told police that he and Donaldson got in an argument over work Donaldson was not completing despite being paid to do it. The victim said Donaldson then began swinging a machete at him, eventually making contact and causing a laceration to his right wrist.

After being continued without a finding for one year, Brian Dorman, 26, of New York, New York, had a July 3, 2022 charge of operating a motor vehicle under the influence of alcohol dismissed.
After being continued without a finding for one year, Theodore A. Feldon, 42, of Nantucket, had an Aug. 7, 2022 charge of operating a motor vehicle under the influence of alcohol dismissed.
Alan L. Fuchsberg, 69, of Nantucket, will have a Aug. 12 charge of failing to stop for police continued without a finding for three months and will have the charge dismissed on the condition he complete three months of probation without a violation. Charges of operating a motor vehicle with a suspended license and a marked lanes violation stemming from the same incident were dismissed.
Angel J. Guillen Ramirez, 25, of Nantucket, had a May 29 charge of assault & battery on a family/household member dismissed due to lack of prosecution.
Isobelle Montgomery Fleming, 20, of Nantucket, was arraigned on Aug. 19 charges of operating a motor vehicle under the influence of alcohol, a motor vehicle equipment violation, and misusing/forging an RMV document. She had not-guilty pleas entered on her behalf and was ordered to return to court Nov. 27 for a pretrial hearing.
Akeem R. Manhertz, 29, of Nantucket, was arraigned on Aug. 19 charges of disorderly conduct and a municipal bylaw violation (possessing an open container of marijuana in a motor vehicle). He had not-guilty pleas entered on his behalf and will have the charges dismissed on the condition he pay $300 in court costs.
George Palmer, 35, of Nantucket, was arraigned on June 29 charges of assault & battery and threatening to commit a crime. He had not-guilty pleas entered on his behalf and was ordered to return to court Oct. 10 for a pretrial hearing.
David St. Clair, 56, of West Chester, Pennsylvania, was arraigned on Aug. 19 charges assault & battery on a person over 60 years old and assault & battery. He had not-guilty pleas entered on his behalf and was ordered to return to court Sept. 11 for a pretrial hearing.
Deily Antonio Veras, 38, of Nantucket, was arraigned on a Aug. 20 charge of assault & battery. He had a not-guilty plea entered on his behalf and was ordered to return to court Oct. 23 for a pretrial hearing.
