This week’s Current Court report includes arraignments and dispositions from the Monday Nantucket District Court session, as well as some cases remaining from last week’s jury trial week.
An 18-year-old island resident has been charged with statutory rape of a child after having sex with his 15-year-old girlfriend, according to a police report. He was arraigned in Nantucket District Court Monday morning, had a not-guilty plea entered on his behalf, and was released on the condition he live with his parents and stay away and have no contact with the alleged victim. He was ordered to return to court in January for a pretrial hearing.
According to the police report, the 15-year-old alleged victim told police that she and the 18-year-old defendant were in a “dating relationship” for several months. She said they engaged in sexual intercourse in her bedroom on November 30th, but the individual being charged did not force her to do so.
According to Massachusetts Law (M.G.L. c. 265, § 23), anyone under the age of 16 cannot legally consent to have sexual intercourse. For example, it is against the law for two 15-year-olds to have sexual relations with one another, even if both willingly agree.
A restraining order was also put into place for one year between the alleged rapist and alleged victim.
Editor’s Note: The identity of the alleged rapist was kept anonymous in this story not to protect him or downplay the seriousness of the charges, but instead to protect the alleged victim from being identified or exposed by this article, while also keeping the community informed as to what news is coming out of the courts.
