This week’s Current Court Report includes arraignments and dispositions from the Monday and Tuesday Nantucket District Court sessions, as well as some cases from last week’s Thursday and Friday sessions.

Adalisbeth Acosta de Aza, 25, of Nantucket had a Dec. 22nd, 2024 charge of assault & battery dismissed due to lack of prosecution after the alleged victim in the case declined to cooperate with prosecutors.

Jesse J. Boulais, 18, of Rhode Island was arraigned on a March 22nd charge of violating an abuse prevention order. He had a not-guilty plea entered on his behalf and was ordered to return to court July 15th for a pretrial hearing.

Cassandra Marie Bustos, 35, of Nantucket had a March 5th charge of assault & battery on a family/household member dismissed due to lack of prosecution after the alleged victim in the case declined to cooperate with prosecutors.

Edwin M. Claflin, 43, of Nantucket was found not-guilty on July 12th, 2024 charges of operating a motor vehicle under the influence of alcohol and negligent operation of a motor vehicle by an island jury. He was found responsible for a marked lanes violation.

Mark Spencer Dickens, 37, of Nantucket had April 3rd charges of assault & battery on a family/household member and strangulation/suffocation, as well as an April 10th charge of violating an abuse prevention order dismissed due to lack of prosecution after the alleged victim in the case declined to cooperate with prosecutors.

Two charges of violating an abuse prevention order remain open and Dickens was scheduled to return to court for a bench trial on June 30th. He may be returning sooner however, because just one day after Dickens had two of the three cases dismissed, the island’s probation office told District Court Judge James Sullivan that Dickens had a violation with his SCRAM unit (alcohol monitoring ankle bracelet), and Sullivan subsequently issued a no-bail warrant for his arrest.

After being continued without a finding for six months, Alex Emerson Horan, 29, of Boca Grande, Florida, had a June 25th, 2024 charge of negligent operation of a motor vehicle dismissed.

Fabio Amaral Paiva, 40, of Nantucket will have a Feb. 28th, 2024 charge of assault & battery, March 11th, 2024 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, failure to stop for police, and a June 19th, 2024 charge of assault continued without a finding for one year. On the OUI charge, Paiva was ordered to forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in fees.

A charge of assault & battery on a person over the age of 60 stemming from the February 28th, 2024 incident, charges of unlicensed operation of a motor vehicle, failure to stop/yield, marked lanes violation, and resisting arrest stemming from the March 11th, 2024 incident were dismissed as part of the plea deal.

Ingrida Cernyte Rascius, 42, of Nantucket will have Oct. 5th, 2023 charges of leaving the scene of property damage and negligent operation of a motor vehicle, a June 14th, 2024 charge of operating a motor vehicle under the influence of alcohol, a June 22nd, 2024 charge of operating a motor vehicle with a suspended license, and a July 12th, 2024 charge of operating a motor vehicle with a suspended license continued without a finding for one year on the condition she complete her probation without a violation, forfeit her license for 45 days, complete a driver alcohol education program, and pay $600 in fees. She was also found responsible for possessing an open container of alcohol in a motor vehicle stemming from the June 22nd, 2024 incident.

An Oct. 17th, 2023 charge of violating a harassment prevention order, charges of speeding and a marked lanes violation stemming from the Oct. 5th, 2023 incident, charges of marked lanes violation, negligent operation of a motor vehicle, and failure to wear a seat belt stemming from the June 14th, 2024 incident, not being in possession of her registration stemming from a June 22nd, 2024 incident, and using a motor vehicle without authority charge stemming from a June 20th, 2024 incident were all dismissed as part of the plea deal.

After being continued without a finding for one year, Samuel F. Rice, 24, of Nantucket had a Feb. 5th, 2024 charge of operating a motor vehicle under the influence of alcohol dismissed.

After completing six months of pretrial probation, Natalia Shurigina-Orlando, 53, of Nantucket had a May 6th, 2024 charge of malicious damage to a motor vehicle dismissed.

After being continued without a finding for six months, Matthew R. West, 27, of Nantucket had a May 26th, 2024 charge of negligent operation of a motor vehicle dismissed.

Adrian Spezza, 34, of West Palm Beach Florida was arraigned on June 5thcharges of operating a motor vehicle under the influence of alcohol and improper operation of a motor vehicle. He had not-guilty pleas entered on his behalf and was ordered to return to court Aug. 11th for a pretrial hearing.

Kenia Garcia Vasquez, 47, of Nantucket had Dec. 22nd. 2024 charges of assault & battery and assault with a dangerous weapon dismissed due to lack of prosecution after the alleged victim in the case declined to cooperate with prosecutors.

Bouchra Yates-Ciarmataro, 42, of Nantucket had a Jan. 3rd charge of assault & battery on a family/household member, a Jan. 13th charge of violating an abuse prevention order, and March 16th charges of assault & battery on a family/household member and violating an abuse prevention order dismissed due to lack of prosecution after the alleged victim in the case declined to cooperate with prosecutors.
