June Jury Week Continues In Nantucket District Court

This Current Court Report includes arraignments and dispositions from the Wednesday and Thursday Nantucket District Court sessions.
Gilbert J. Holdgate, 63, of Nantucket pleaded guilty to two July 9th, 2023 charges of assault with a dangerous weapon and one charge of threatening to commit a crime. A charge of committing a Civil Rights Violation, which stemmed from the alleged victim telling police that the third time Holdgate drove by him in the incident, Holdgate started yelling the n-word at him and then said “I will shoot you n****a, you f***ing n***a,” was dismissed as part of the plea.
Holdgate was ordered to complete 50 hours of community service and will need to complete counseling sessions. His probation will be one year and 11 months – ending on May 4th, 2027. He was also ordered to stay away and have no contact with the victim and their family. Assault with a dangerous weapon is a felony, which means Holdgate will now be required to submit a DNA sample to the government as a convicted felon.
According to the police report, Holdgate got into a verbal altercation with an individual who was unhappy with how Holdgate parked at the Stop & Shop at 9 Salem Street. Holdgate proceeded to drive around the lot multiple times, and the victim then told police Holdgate proceeded to turn his wheel and drive in the direction of the victim in an attempt to hit him with his truck. The alleged victim had to jump out of the way of the vehicle as it drove past him, and then Holdgate allegedly put the truck in reverse and attempted to hit the man a second time.
Giorgi Arshaulidze, 24, of Nantucket was found not-guilty on June 5, 2024 charges of negligent operation of a motor vehicle and operating a motor vehicle under the influence of alcohol by Judge James Sullivan prior to a jury trial after a motion by Arshaulidze’s lawyer Jim Merberg to dismiss the case due to lack of probable cause was granted by Sullivan following deliberations in courtroom between Merberg and the Cape & Islands District Attorney's office. He was found responsible for failure to wear a seat belt and speeding.
A subsequent motion by Merberg on behalf of his client to reinstate his client’s license was granted by the court.
Anita M. Cuello, 24, of Nantucket was arraigned on an April 14th charge of leaving the scene of property damage. She had a not-guilty plea entered on her behalf and was ordered to return to court July 22nd for a pretrial hearing.
Marcio S. Rodrigues da Silva, 46, of Nantucket had his jury trial on June 30th, 2024 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, and speeding end in a mistrial after the jury was split 4-2 on a verdict. Silva was scheduled to reappear in court Aug. 5th for another trial session.
