This week’s Current Court Report includes arraignments and dispositions from the Tuesday Nantucket District Court session.
Caverly Brooks, 25, of Nantucket was arraigned on May 24th charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, and leaving the scene of property damage. She had not-guilty pleas entered on his behalf and was ordered to return to court July 13thfor a pretrial hearing.
Vasco Cal Cabral, 32, of Nantucket was arraigned on May 24th charges of operating a motor vehicle under the influence of alcohol and negligent operation of a motor vehicle. He had not-guilty pleas entered on his behalf and was ordered to return to court June 30th for a pretrial hearing.
Ademir Alvarenga Ferreira, 34, of Nantucket was arraigned on May 21stcharges of assault & battery and assault & battery on a police officer. He had not-guilty pleas entered on his behalf and was ordered to return to court June 29th for a pretrial hearing.
According to the police report, Ferreira allegedly got into a confrontation at his home with a housemate and slapped him across the face before punching him in the face with a closed fist multiple time. Ferreira also spit on a state trooper’s boot multiple times according to the report and was “extremely intoxicated.”
After being continued without a finding for one year, Vincent Carl Benoit, 22, of Nantucket had a January 7th, 2023 charge of using a motor vehicle without authority, May 19th, 2024 charges of operating a motor vehicle with a suspended license and negligent operation of a motor vehicle, and January 4th, 2025 charges of operating a motor vehicle under the influence of alcohol, leaving the scene of property damage, operating a motor vehicle with a suspended license, negligent operation of a motor vehicle, larceny of a motor vehicle, and three additional charges of leaving the scene of property damage dismissed.
Estefany Cruceta Gonzalez, 33, of Nantucket was arraigned on a February 13th charge of intimidating a witness/juror/police/court official. She had a not-guilty plea entered on her behalf and was ordered to return to court June 29thfor a pretrial hearing.
Theodore Michael Charles Fales, 33, of Nantucket had a November 23rd, 2025 charge of assault & battery on a family/household member dismissed due to lack of prosecution after the alleged victim in the case declined to cooperate with prosecutors.
Jorge A. Guzman, 31, of Nantucket was arraigned on April 26th charges of assault & battery on a family/household member and threatening to commit a crime. He had a not-guilty plea entered on his behalf was ordered to return to court June 29th for a pretrial hearing.
According to the police report, Guzman allegedly pushed a woman while he was retrieving belongings and sent a text message on April 10th to the alleged victim where he said “I hope you never look for me in your life, because if you do, I’ll break your head even if I go to prison for life.”
The Cape & Island District Attorney’s office sought to have Guzman’s bail revoked on two open cases Guzman is facing including one where he is facing two counts of possessing cocaine to distribute and another case where he is facing a larceny over $1,200 by a single scheme charge. The request was denied by District Court Judge Paul Pino.
Benjamin N. McPherron, 25, of Nantucket was arraigned on May 24th charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, a lights violation, and unlicensed operation of a motor vehicle. He had not-guilty pleas entered on his behalf and was ordered to return to court June 29th for a pretrial hearing.
Nataly Stephanie Nataren Benitez, 34, of Nantucket had an April 2nd charge of assault & battery dismissed due to lack of prosecution after the alleged victim in the case declined to cooperate with prosecutors.
Justo Pastor Rivera Valverde, 26, of Nantucket will have a November 14th, 2025 charge of operating a motor vehicle under the influence of alcohol continued without a finding for one year on the condition he complete a driver alcohol education course, forfeit his license for 45 days, pay $600 in fees, and complete the probation without any violations. Charges of failure to drive in the right lane, negligent operation of a motor vehicle, and possessing an open container of alcohol in a motor vehicle dismissed as part of a plea.
Jake W. Toy, 46, of Nantucket was ordered to complete one year of pretrial probation on October 15th, 2025 charges of criminal harassment, trespassing, disturbing the peace, and a bylaw violation. He was also ordered to stay away from the victim’s residence, stay away and have no contact with the victim, and complete mental health evaluations.
Toy was the island resident who was charge after allegedly "peeping" inside of a woman’s home on three separate occasions. One in the summer of 2024, another in February of 2025, and a third incident on October 15th, 2025.
According to the police report, police responded to a Boyers Alley Way residence after a female party reported observing a black male suspiciously in her backyard. Police were unable to locate the man upon arrival but began an investigation. The alleged victim told police that on the night of the incident, she was home alone in a well-lit living room area of her home when she first observed the man in the backyard outside of a window that looked directly into the living room of the home. Fallen leaves were observed to be freshly rustled away on the ground at the time of the police response – indicating that someone was standing outside of the window.
Police obtained surveillance footage that showed the man, later identified as Toy, standing outside of the window. It was later discovered that there were two separate incidents where Toy was “unlawfully lurking” in the area that were recorded via surveillance, along with the October 15th incident. One being in February of 2025 and the other in the summertime of 2024.
Police said the alleged victim was visibly upset, crying, and very scared after “unexpectedly observing Mr. Toy peeping at her in her yard.” Police said Toy has no ties to the Boyers Alley Way residence or any neighboring properties. He was also observed on a surveillance system of a Warren Street property, which is right next to the Boyers Alley Way residence, being told by the homeowner through the audio capacities of the surveillance system that he is not welcome on the property.
Police added that Toy has a criminal history that includes breaking and entering, as well as being cited in the past for “peeping and spying.” They said when Toy was arrested, he was wearing the same sweatshirt as the alleged victim described him as wearing on October 15th.
