This week’s Current court report includes arraignments and dispositions from the Monday and Tuesday Nantucket District Court sessions. It is led by two island residents who were arrested following an FBI raid last year agreeing to a plea deal on the drug and ammunition charges they were facing. It also includes the arraignment of a man facing indecent assault & battery charges.

Victor A. Ramirez Valdivies, 33, of Nantucket and Carlos Arnulfo Vasquez Hernandez, 32, of Nantucket each had November 21st, 2024 charges of trafficking cocaine in an amount 18 grams or more but less than 36 grams amended down to possessing a Class B drug, and will have the charges continued without a finding for six months. Charges of possessing ammunition without an FID card stemming from the same incident were dismissed for each defendant.

Valdivies and Hernandez were both arrested following an FBI raid of a Hooper Farm Road property in 2024. They were not the target of the FBI raid. The target was, John Lee Angel, 31, who was taken into custody without incident and transported to Boston at the time of the raid. His case remains open.

Dhruba Bahadur Khadka, 54, of Nantucket was arraigned on Oct. 8th charges of assault & battery (five charges) and indecent assault & battery on a person 14 or over (two counts). He had not-guilty pleas entered on his behalf and was ordered to return to court January 6th, 2026 for a pretrial hearing.

According to the police report, Khadka allegedly grabbed and touched his waitress while she was near his table working her shift. The alleged victim wrote in her statement Khadka “inappropriately patted” her backside two different times after midnight while she was near his table and the other while she was behind the bar. Police reviewed security footage and confirmed they saw Khadka engaging in multiple intentional encounters of unwanted touching, which also included grabbing her waist, grabbing her hands and arms, hugging her, and pulling her onto his lap.

Jonathan Alexander Benitez Menjivar, 29, of Nantucket will have July 8th charges of negligent operation of a motor vehicle and a marked lanes violation continued without a finding for one year on the condition he complete the probation without a violation. He was found not responsible on a speeding charge stemming from the same incident.

Scott Maguire Estill
, 51, of Nantucket was found not-guilty by Judge James Sullivan during a bench trial on a July 20th charge of operating a motor vehicle under the influence of alcohol, but will have a negligent operation of a motor vehicle charge stemming from the same incident continued without a finding for one year on the condition he complete his probation without a violation.

Andrew L. Falkenstein
, 58, of Nantucket had seven January 11th, 2024 charges of vandalizing property and one charge of trespassing stemming from the same incident dismissed due to lack of probable cause.

Galisa M. Francis
, 36, of Nantucket was arraigned on August 14th charges of negligent operation of a motor vehicle, operating a motor vehicle with a suspended license (subsequent offense), and a crosswalk violation. She had not-guilty pleas entered on her behalf and was ordered to return to court December 15th for a pretrial hearing.

Airam Zoe Gonzales
, 26, of Nantucket had an April 12th charge of larceny over $1,200 dismissed due to lack of prosecution.

Yasael Gonzalez Hernandez
, 27, of Nantucket was arraigned on November 1st charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, possessing an open container of alcohol in a motor vehicle, unlicensed operation of a motor vehicle, and improper operation of a motor vehicle. He had not-guilty pleas entered on his behalf and was ordered to return to court November 10th for a pretrial hearing.

Jason C. Irving
, 51, of Nantucket will have a July 1st, 2024 charge of operating a motor vehicle under the influence of alcohol continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in fees. Charges of negligent operation of a motor vehicle and a marked lanes violation stemming from the same incident were dismissed.

Ryan C. Jepson
, 43, of Nantucket completed his one year of probation on a guilty plea to a September 2nd, 2024 charge of assault & battery on a police officer, and the case is now closed.

After being continued without a finding for one year, Jepson had a March 24th, 2024 charge of operating a motor vehicle under the influence of alcohol dismissed.

Eric Michael Keyes
, 42, of Nantucket will have June 1st charges of operating a motor vehicle under the influence of alcohol and reckless operation of a motor vehicle continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in fees. Charges of failure to stop for police and operating a motor vehicle with a suspended license stemming from the same incident were dismissed.

Rowan G. MacLachlan
, 19, of Nantucket will have a June 25th charge of leaving the scene of property damage dismissed on the condition he pay $200 in court costs.

Leonel Mancia Castro
, 57, of Nantucket will have December 6th, 2024 charges of operating a motor vehicle under the influence of alcohol, operating a motor vehicle with a suspended license, and leaving the scene of property damage continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in court costs. A charge of negligent operation of a motor vehicle stemming from the same incident was dismissed.

Sean R. McGrady
, 58, of Nantucket will have a November 7th, 2024 charge of threatening to commit a crime continued without a finding for one year on the condition he complete the probation without a violation.

Robert E. Monroe
, 50, of Nantucket pleaded guilty to a September 2nd, 2024 charge of operating a motor vehicle under the influence of alcohol (second offense) and was found responsible for speeding, and was ordered to complete one year of probation, forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in fees. He will also have a negligent operation of a motor vehicle charge continued without a finding for one year concurrently.

Charges of failure to stop/yield, speeding, and marked lanes violation stemming from the same incident were dismissed.

John M. Montgomery
, 30, of Nantucket will have a May 25th charge of operating a motor vehicle under the influence of alcohol continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in fees.

Luke P. Pascucci
, 29, of Nantucket had June 11th charges of assault & battery, strangulation, and possessing a Class E drug dismissed due to lack of prosecution.

Junior Discalis Perez
, 34, of Nantucket was arraigned on a November 3rdcharge of assault & battery with a dangerous weapon. He had a not-guilty plea entered on his behalf and was ordered to return to court November 17thfor a pretrial hearing.

Misael De Jesus Pu Barrera
, 26, of Nantucket will have an August 20thcharge of operating a motor vehicle under the influence of alcohol continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in fees. Charges of possessing an open container of alcohol in a motor vehicle and failure to wear a seatbelt stemming from the same incident were dismissed.

Adam A. Smith
, 40, of Nantucket will have an August 30th charge of operating a motor vehicle under the influence of alcohol continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, and pay $600 in fees. Charges of negligent operation of a motor vehicle and a marked lanes violation stemming from the same incident were dismissed.

Christopher J. Wessell
, 62, of Nantucket pleaded guilty to an April 19th charge of shoplifting by concealing merchandise. He was ordered to pay the victim back for the merchandise stolen.

After being continued without a finding for one year, Ryan M. Williams, 41, of Nantucket had a June 8th, 2024 charge of operating a motor vehicle under the influence of alcohol dismissed.
