This week’s Current Court Report includes arraignments and dispositions from Monday’s Nantucket District Court session. It is led by the man involved in July’s hit & run agreeing to a plea deal with the Cape & Island’s District Attorney’s Office and a man pleading guilty to charges that include breaking into a home.
Roberto Curvelo Campos, 35, of Nantucket will have July 23 charges of operating a motor vehicle under the influence of alcohol and leaving the scene of personal injury continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, pay a $250 program fee, $250 head-injury fee, $50 victim-witness fee, and $50 OUI fee.
Campos had a charge of negligent operation of a motor vehicle stemming from the same incident dismissed and he was found not responsible on charges of failing to stop/yield and a marked lanes violation.
Campos was involved in a July hit & run. He hit a car on Old South Road before fleeing the scene and being pulled over by state police on Milestone Road. Passerbys and pedestrians who were in the area of the route taken by the truck from Old South Road to Milestone Road told the Current that the truck was fleeing the scene - nearly hitting pedestrians along the way.
Cory Vaughn Francis, 33, of Nantucket pleaded guilty to July 25 charges of breaking and entering a building in the nighttime for a felony, malicious destruction of property over $1,200, and violating an abuse prevention order.
He was given two years in the Barnstable House of Correction but will only need to serve nine months with the remaining balance suspended for two years on the condition he complete two years of probation without a violation.
On the destruction of property charge, Vaughn was ordered to serve two years of probation and pay $814 in restitution to the victim.
On the abuse prevention order violation, Vaughn was ordered to serve two years of probation, complete a batterers program, stay away and have no contact with the victim, and was ordered to wear a GPS tracking device. He was also given exclusion zones he is not permitted to be in on the island.
Francis was involved in a nighttime break-in back in July. Some of the damage found by officers in the upstairs of the home Vaughn broke into included broken doors, a flat-screen TV ripped off the wall with the screen smashed, and a child’s iPad with a broken screen. The child’s room floor had food dumped on it with a large number of broken shards of glass. There were holes in various walls, makeup dumped onto the ground and placed in a running bathroom sink.
In other court news this week, Daniel J. Benitez Bonilla, 22, of Nantucket was arraigned on Oct. 4 charges of operating a motor vehicle under the influence of alcohol, leaving the scene of property damage, marked lanes violation, negligent operation of a motor vehicle, possession of an open container of alcohol, and driving with an unsecured/uncovered load. Bonilla had not-guilty pleas entered on his behalf and was ordered to return to court Oct. 30 for a pretrial hearing.
Samir Bonomo, 48, of Nantucket was arraigned on Sept. 2 charges of assault & battery and disorderly conduct. He had not-guilty pleas entered on his behalf and was ordered to return to court Dec. 4 for a pretrial hearing.
Alberth Steven Obando, 34, of Nantucket was arraigned on Sept. 3 charges of assault & battery on a police officer, assault & battery, indecent assault & battery on a person 14 or older, and disorderly conduct. He had not-guilty pleas entered on his behalf and was ordered to return to court Dec. 4 for a pretrial hearing.
According to the police report, Obando and Bonomo were involved in a physical altercation with one another downtown just prior to midnight on September 2. Bonomo told police he initiated the altercation after he inappropriately touched a female without her consent.
NPD officer Jack Moran said that Obando appeared to be going in and out of consciousness due to both the altercation and being intoxicated. He had blood in his facial/mouth area from multiple lacerations.
Officers attempted to provide medical care to Obando before the Nantucket Fire Department arrived. Obando allegedly yelled “F*** you” at the officers multiple times and spit blood on one of the officers – landing on his uniform. His behavior also drew a small crowd, Moran said, of people startled by his behavior.
Police spoke to the alleged victim who was touched by Obando, who told police he wrapped his arms around her without her consent, prompting her to push him off of her. Obando then reapproached the woman and touched her inappropriately without her consent.
Megan Browers, 43, of Nantucket was arraigned on Oct. 7 charges of operating a motor vehicle under the influence of alcohol, negligent operation of a motor vehicle, and a marked lanes violation. She had not-guilty pleas entered on her behalf and was ordered to return to court Oct. 30 for a pretrial hearing.
After being continued without a finding for 90 days, William David Ciarmataro Jr., 39, of Nantucket had a May 26 charge of resisting arrest dismissed.
Luiz Antonio Da Silva Junior, 48, of Nantucket, will have Aug. 14 charges of operating a motor vehicle under the influence of drugs and negligent operation of a motor vehicle continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, pay a $250 program fee, $250 head-injury fee, $50 victim-witness fee, and $50 OUI assessment fee.
A charge of leaving the scene of property damage stemming from the same incident was dismissed. He was found not responsible for a marked lanes violation.
Patrick A. Drysdale, 47, of Nantucket had a July 30 charge of assault & battery on a family/household member dismissed due to lack of prosecution.
Josh Gray, 42, of Nantucket, will have Sept. 4 charges of operating a motor vehicle under the influence of alcohol and leaving the scene of property damage continued without a finding for one year on the condition he forfeit his license for 45 days, complete a driver alcohol education program, write a letter of an apology, pay a $250 program fee, $250 head-injury fee, $50 victim-witness fee, and a $50 OUI assessment fee.
Gray was found not responsible for a marked lanes violation and had charges of leaving the scene of property damage and negligent operation of a motor vehicle stemming from the same incident dismissed.
Richard E. Moore, 56, of Nantucket will have a May 27 charge of assault & battery continued without a finding for one year on the condition he complete one year of probation without violation. He had a second assault & battery charge stemming from the same incident dismissed.
John Mullen, 50, of Brookline, New Hampshire was arraigned on Oct. 9 charges of assault with a dangerous weapon, malicious destruction of property under $1,200, and disturbing the peace. He had not-guilty pleas entered on his behalf and was ordered to return to court Oct. 30 for a pretrial hearing.
According to the police report, officers were dispatched to the Nantucket Inn on Oct. 9 at 9:25 p.m. for the report of a man screaming, banging on doors, and wielding a knife. Police located the man – identified as Mullen – in the front lobby.
Jennifer Perry, 53, of Nantucket was arraigned on Oct. 7 charges of assault & battery and assault with a dangerous weapon. She had not-guilty pleas entered on his behalf and was ordered to return to court Oct. 23 for a pretrial hearing.
Bradford G. Phelps, 56, of Nantucket pleaded guilty to May 20 charges of operating a motor vehicle under the influence of alcohol (second offense) and negligent operation of a motor vehicle. He was given six months in the Barnstable House of Corrections but will have that balance suspended for two years on the condition he complete the probation without a violation.
Phelps was also ordered to complete a driver alcohol education program, pay a $250 program fee, $250 head-injury fee, $50 victim-witness fee, and $50 OUI assessment fee. A charge of possessing an open container of alcohol in a motor vehicle stemming from the same incident was dismissed.
Mario A. Pleitez, 41, of Nantucket will have a Dec. 9, 2022 charge of negligent operation of a motor vehicle continued without a finding for one year on the condition he complete one year of probation, pay a $250 head-injury fee, and $50 victim-witness fee. He was found not responsible for a speeding charge.
Daniel Rax Tziv, 37, of Nantucket was arraigned on two Oct. 8 charges of assault & battery with a dangerous weapon. He had not-guilty pleas entered on his behalf and was ordered to return to court Dec. 26 for a pretrial hearing.
