Three Men Indicted On Rape Charges In Nantucket Superior Court

The Nantucket Superior Court will begin its two-week session on Monday, and on the docket is a pair of arraignments, including a 29-year-old man who allegedly sexually assaulted a seven-year-old girl and a 32-year-old man who allegedly sexually assaulted a woman and took videos of her while she was nude without her consent.
There is also a pretrial conference scheduled for a 49-year-old man who was indicted on 11 sexual assault charges in Superior Court on August 13 and arraigned the following day.
The two Superior Court arraignments, which are scheduled to take place on October 2, will be Yoaris Manuel Eustate Alvarado, 32, and Manuel Antonio Figueroa Vega, 29.
Alvarado will be arraigned on three charges of rape, two charges of photographing an unsuspecting person in the nude, and one charge of distributing obscene matter. Alvarado had indictments returned on these charges on August 13 and was ordered on August 21 to appear in Superior Court for an arraignment session on the October 2 date.
According to the police report, Nantucket Police Detective Amanda Schwenk began an investigation in April of 2023 following a report from the alleged victim that she was being videotaped without consent.
Schwenk stated that after a warrant was issued to search Alvarado’s phone, a forensic download was conducted – revealing videos of the alleged victim in which she was nude. Two of the videos were recorded on January 7, 2023, and the alleged victim said she did not consent to being filmed or any sexual activity.
The alleged victim was able to identify Alvarado in the videos due to the distinct tattoos on his hands, a yellow banded Apple Watch, and his voice.
Vega meanwhile had indictments returned on September 16 for two charges of aggravated rape of a child (five-year age difference). He was ordered to appear in court on October 2 as well for his arraignment.
According to the police report, officers responded to the Nantucket Cottage Hospital on July 25, 2024, following the report of a seven-year-old girl being brought to the emergency room by her mother to be treated for a sexual assault.
Police entered the emergency room, and the alleged victim told police that Vega had sexually assaulted her. The Current is not publishing details of the assault due to the severity of the incident described in court documents.
The alleged victim disclosed during a forensic interview that a pair of sexual assaults took place on July 23 and July 25.
Elmer Sola, 49, was indicted by a grand jury on three counts of aggravated rape of a child (ten-year age difference) and eight counts of indecent assault & battery on a child under the age of 14. Sola had not-guilty pleas entered on his behalf and is scheduled to appear for a pretrial conference on Wednesday, October 2.
Sola had his bail set at $5,000 cash, $50,000 surety. He had several conditions tied to his probation, including that he wear a GPS monitoring device, stay at least 100 yards away from the alleged victim and the alleged victim's family, and to stay away and have no contact with the alleged victim and her family.
According to court records, Sola was brought back into court just nine days later, on August 23, for a probation administrative conference after he allegedly violated the pretrial conditions of his release. There was no change to his bail status.
Sola was one of three individuals taken into custody by federal Immigration and Customs Enforcement (ICE) agents on Sept. 10, who they said was in the country illegally after entering the country on an unknown date at an unknown location, without being inspected, admitted or paroled by a U.S. immigration official.
