An island painter filed a lawsuit in Nantucket Superior Court this week against Forty Five Fair Street LLC, managed by former New England Patriots head coach Bill Belichick, seeking nearly $300,000 for an injury he sustained while working on one of the legendary head coach’s Nantucket properties.
Andrew Jackson, the painter seeking damages against Belichick, alleges that on June 21st, 2024, he was working on Belichick's property located at 45 Fair Street. While working, he allegedly slipped and fell while on the site due to unsafe conditions he describes as such as "the placement, use, and/or maintenance of plastic sheeting or coverings and other unsafe site conditions in the work area.”
“As a direct and proximate result of the fall, plaintiff sustained serious bodily injuries including a severe right ankle injury, together with pain, disability, medical expenses, lost wages, and other consequential damages,” the lawsuit says.
Jackson’s lawyer Isabela Orlacchio Garcia says in the lawsuit that he has received workers' compensation benefits through his employer/subcontractor's insurer, but retains his rights to pursue this third-party negligence action against Belichick as a responsible party.
“As a direct and proximate result of defendant's negligence, plaintiff has suffered and continues to suffer bodily injury, physical pain and suffering, mental anguish and emotional distress, medical expenses, lost wages and impairment of earning capacity, loss of function and enjoyment of life, and such other damages as may be proven at trial,” the lawsuit concludes.
Jackson is requesting compensatory damages in an amount to be determined at trial, pre-judgment and post-judgment interest as permitted by law, costs of suit, and any other relief the court deems “just and proper.”
