Lawsuit Filed Against Richmond Developers, Contractor For Faulty Construction

The owners of 45A and 45B Beach Grass Road are seeking $350,000 in damages from Richmond Great Point Development and BRT Management in a lawsuit filed last month that reveals the unit owners allegedly discovered several issues of defective construction regarding the structure, grounds of the condominium, and their respective units that have cost thousands of dollars to repair, with pricey repairs also needed in the future.

“Despite repeated demands for the Defendants to remedy or remediate the defects and problems at the Condominium, Unit 45A, and 45B, the Defendants have neglected, failed, and refused to address said issues and have caused serious physical harm to the Condominium, Unit 45A, and Unit 45B and related financial harm to (the homeowners)," the suit says.

The lawsuit was filed by the 45 Beach Grass Road Condominium Association, which represents the owners of the two units. Corbet Campbell purchased 45A Beach Grass Road on March 11th, 2022 and Hafsa Lewis purchased 45B Beach Grass Road on March 28th, 2022. They are the only two members of the organization.

A demand letter was sent to Richmond and BRT Management, who was the contractor hired by Richmond to perform the work, on January 8th. Some of the issues with the units include 45A Beach Grass needing repairs to its roof. Those repairs initially totaled $20,000 due to water entering the building because the roof was incorrectly constructed. An additional $50,000 is now estimated to be needed after the repairs revealed an entirely new roof was needed.

As for 45B Beach Grass Road, improper grading and scaling of a rear parking lot allegedly led to significant water damage in the basement after numerous attempts to bring this to the attention of Richmond were apparently not responded to. Repairs for the water damage are estimated to cost approximately $60,000.

The plaintiffs are seeking a judgment in their favor of no less than $350,000, plus reasonable attorneys' fees and interest at 12% per year, which they say they are entitled to according to Massachusetts law. They are also asking for an award of double or treble damages plus reasonable attorneys' fees and interest at 12% per annum under another Massachusetts law, as well as any additional orders or relief as a judge deems appropriate and necessary.

The defendants are also facing seven counts in the lawsuit including Breach of Contract, Breach of the Covenant of Good Faith and Fair Dealing, Fraud-Deceit, Breach of Implied Warranty of Habitability, Negligent Construction, Unjust Enrichment, and Violation of M.G.L. Chapter 93A.
