Island Resident Facing Rape, Assault & Battery Charges Has Cases Dismissed

An island resident who has been held in Barnstable since mid-July following an arraignment in Nantucket District Court on rape and assault & battery charges had his cases dismissed by Nantucket District Court Judge James Sullivan after the Cape & Island’s District Attorney’s office told the court that the alleged victim expressed to them she wants “nothing to do with the case” and would not testify.
Roberto Ramos, 46, of Nantucket, was facing a July 9th charge of rape and July 10th charges of assault and battery on a family/household member and strangulation. He was released Friday morning after assistant district attorney Shaunna Souve told Nantucket District Court Judge James Sullivan that the alleged victim told prosecutors she wants nothing to do with this case, has no intention of returning to the island, and told them it is in her best interest to move on from the incident.
The charges stemmed from a domestic violence incident on July 10th, according to police. In the aftermath, the alleged victim had told investigators that she had been sexually assaulted less than 24 hours before the incident on the morning of July 9th.
According to the police report, officers were dispatched to a Hinsdale Road residence for a reported domestic assault and battery at midnight on July 10. Over an hour later, on July 10 at 1:45 a.m., police spoke to the victim at the police station. The victim reported the rape to the police and said it took place on Wednesday, July 9, at approximately 6:30 a.m.
